Trade mark filing fees increase
Published on 14 Sep, 2012
In May 2012, Shelston IP reported on various official fee increases for trade mark matters. Some of those increases will come into effect on 1 October 2012:
Item (per class) | Current Fee | Fee from 1 October 2012 |
Electronic application – no pick list | $160 | $200 |
Electronic application – with pick list | $120 | $120 |
Electronic Series Trade Mark Application – with pick list | $270 | $270 |
Electronic Series Trade Mark Application – without pick list | $310 | $350 |
The pick list, referred to above, is a listing of various descriptions of goods and services whose classification has been approved by IP Australia. The pick list can be used if the goods and/or services are being described using general standard descriptions but often it does not allow for tailored or precise descriptions. Therefore it can be useful if the Applicant wishes to file for a simple description of goods and/or services and wishes to minimise their costs.
When Shelston IP receives instructions for a new filing, we will review the instructions to ascertain whether the application can be filed using the pick list.
For businesses who are currently contemplating filing a new trade mark application in Australia, they may wish to consider filing the application before the 1 October 2012 fee increases.
Although IP Australia is increasing its fees, Shelston IP will not be increasing its service charges for filing new trade mark applications.
